Somalia’s Constitutional Milestone: Understanding the 2026 Revised Constitution
April 2026, Mogadishu — The Somali president Hassan Sheikh Mohamud signed and published in the gazette the revised constitution, which led Somalia to a new path in its politics and replaced the provisional constitution of 2012.
The draft of the constitution introduces major reforms, including the supremacy of the federal government constitution over the state-level constitutions, new resource-sharing mechanisms, the establishment of the Somali Council of Islamic Scholars and the National Revenue Authority, and the extension of the term of the federal institution of the office from four to five years. Furthermore, it outlined a new legal framework that unifies the governmental structure of the federal states.
The constitution does not have general acceptance, and the process has sparked controversy. Puntland and Jubaland states have not endorsed the new constitution, citing concerns over the centralization of power and lack of broad-based agreement.
The implementation of the new revised constitution will extend the term of the incumbent government into a year, which may create political crises and instability. The constitution will remain provisional until it gets a public referendum to become permanent.
